#### Describes building a business around WordPress.org as a "gamble"

In [Opposition/Response to Motion](https://storage.courtlistener.com/recap/gov.uscourts.cand.437474/gov.uscourts.cand.437474.33.0.pdf) filed on 2024-10-22, Matt's lawyers describe WordPress.org as "Mr. Mullenweg’s website".

> Rather than being about access to WordPress software, this case instead is about WordPress.org – a website owned and run by Defendant Matt Mullenweg individually, for the benefit of the community he loves.
The legal filing goes on to describe the mistake WP Engine made in building a business that relies on WordPress.org:

> In doing so, WP Engine gambled for the sake of profit that Mr. Mullenweg would continue to maintain open access to his website for free.
Are we all taking the same gamble, that Matt will continue to provide open access to WordPress.org to us for free?

> WordPress.org is not WordPress. WordPress.org is not Automattic or the WordPress Foundation, and is not controlled by either. To the contrary, as Plaintiff itself acknowledges, WordPress.org is Mr. Mullenweg’s responsibility.
On Twitter, a former Automattic employee responds:

On October 2nd, Matt said this on Hacker News ([source](https://news.ycombinator.com/item?id=41726796)):
