Looks like you can't remove a check:

the settlementSheet's toggleNemesisLevel() method now adds a nemesis encounter handle if one is missing.

The RCA on this one is that the API was checking type and not sub_type when evaluating the monster asset and determining whether to add a new list of encounters to the settlement.
