Terms of Use and Disclaimer

This software application is a tool for authoring inference engine rules and was created under an award
from the U.S. Department of Health and Human Services (“HHS”) to the University of Texas Health Science
Center at Houston (University of Texas) as Prime Recipient and IHC Health Services, Inc. (“IHCHS”) as
Subrecipient (the “Award”).

This software application is referred to below as the “Tool”.

	1.	Use and Compliance with Laws.
	This Tool is made available for download and use by others, but only for lawful and ethical purposes and uses.
	Each user of the Tool must ensure that the Tool is used in strict compliance with all applicable laws and
	regulations and with high standards of professional healthcare ethics.  The Tool must not be exported or
	re-exported in violation of any U.S. laws or regulations.  The Tool must not be used in any manner or application
	that is hazardous or may cause injury to any person.

	2.	No Data.
	The Tool does not include any protected health information, personally-identifiable information, or any other data.

	3.	No Fees.
	There are no license fees, royalties or other fees payable for use of the Tool as permitted herein.

	4.	Disclaimers.
	THE TOOL IS PROVIDED AND ACCEPTED “AS IS” WITHOUT WARRANTY OR REPRESENTATION OF ANY KIND.  ALL IMPLIED WARRANTIES,
	INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF NONINFRINGEMENT, MERCHANTABILITY, TITLE, OR FITNESS FOR A
	PARTICULAR PURPOSE ARE DISCLAIMED AND EXCLUDED.  THERE IS NO REPRESENTATION OR WARRANTY THAT THE TOOL WILL SATISFY
	A USER’S REQUIREMENTS OR THAT IT IS WITHOUT DEFECT OR ERROR OR THAT THE OPERATION THEREOF WILL BE UNINTERRUPTED.
	EACH USER IS SOLELY RESPONSIBLE FOR DETERMINING THE SUITABILITY OF THE TOOL AND FOR TESTING AND EVALUATING IT BEFORE
	ANY USE OF OR RELIANCE ON THE TOOL.  ANY PERSON WHO USES OR RELIES ON THE TOOL OR THE RULES, OUTPUT, OR DATA IT
	PRODUCES ASSUMES ALL RISKS AND LIABILITIES ASSOCIATED WITH THE TOOL AND THOSE RULES, OUTPUT, AND DATA, INCLUDING,
	WITHOUT LIMITATION, DEFECTS, PROGRAMMING ERRORS, PRODUCT LIABILITY CLAIMS, THE INFRINGEMENT OF THIRD PARTY RIGHTS
	OR INTELLECTUAL PROPERTY, AND ANY OTHER PROBLEMS RELATING TO THE TOOL.  ALL SUCH USE AND RELIANCE MUST BE BY
	QUALIFIED PROFESSIONALS WHO EXERCISE THEIR OWN INDEPENDENT PROFESSIONAL JUDGMENT.  THE TOOL IS NOT INTENDED,
	LICENSED OR PROVIDED FOR USE IN THE DIAGNOSIS, CURE, MITIGATION, TREATMENT, MONITORING, OR PREVENTION OF ANY
	DISEASE, CONDITION OR PATIENT.

	5.	Government Awards.
	The Tool and all use of it are subject to the Award and any requirements and limitations (contractual, governmental,
	or otherwise) applicable to the Award.
