I think given the rule doc says "which can indicate an unfinished test." this is technically a bug, but I think a fair counter argument would be that when the expect is a loop it won't get called if you have an empty array (and determining if that is possible is out of scope imo - in your example it's possible, but that won't always be the case and as you've said really this should be using it.each)
